• “We,” “us,” “VOCAL”, or “our” refers to Vocal Tech India Pvt Ltd, the hosting provider.
• “You,” “your,” or “customer” refers to the individual or entity using our shared hosting services.

2. Acceptance of Terms

By signing up for, using, or accessing our shared hosting services, you agree to comply with and be bound by these Terms and Conditions, our Acceptable Use Policy, and any other policies or guidelines referenced herein.

3. Service Description

3.1 VOCAL agrees to provide the Customer with shared hosting services as described in the selected hosting plan, including server resources, disk space, bandwidth, and features.

3.2 The Customer acknowledges that shared hosting means resources are shared among multiple users, and Provider may take measures to ensure fair resource allocation.

4. Payment and Billing

4.1. Payment: You agree to pay all fees and charges associated with your hosting plan as specified on our website. Payment is due in advance for the selected billing period.

4.2. Billing: Hosting plans are billed on a recurring basis (e.g., monthly, annually). It is your responsibility to keep your billing information up-to-date. Failure to pay may result in the suspension or termination of your hosting services.

5. Account Security

You are responsible for maintaining the security of your account, including but not limited to passwords, FTP credentials, and other login information. Any unauthorized use of your account is your responsibility. VOCAL is not responsible for any unauthorized access to the Customer’s account due to the Customer’s negligence in protecting their login credentials.

6. Content and Usage

6.1. Acceptable Use: You agree not to use our hosting services for any unlawful, abusive, or unethical purposes, including but not limited to the distribution of malware, spam, or copyrighted materials without proper authorization.

6.2. If the website developed other then VOCAL, you need to provide the backup of your website and it will be made live by VOCAL team only. You will not allotted or provided with our shared hosting credentials .The shared hosting handled by VOCAL only.

6.2. Data Backups: We recommend that you maintain your own backups of your website content and data. While we may provide backup services, we are not responsible for data loss.

7. Suspension and Termination

We reserve the right to suspend or terminate your hosting account, with or without notice, if you violate these Terms and Conditions or our Acceptable Use Policy. In case of termination, you will not be entitled to a refund. You are only allowed to get the latest backup of your website.

8. Service Level Agreement (SLA)

We strive to provide reliable hosting services. Our SLA, available on our website, outlines our commitments regarding uptime and support response times.

9. Intellectual Property

You retain ownership of all content and data you upload to our servers. By using our services, you grant us a limited license to host, display, and distribute your content as necessary to provide the hosting services.

10. Limitation of Liability

We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our hosting services, including but not limited to data loss, downtime, or service interruptions.

11. Changes to Terms and Conditions

We may modify these Terms and Conditions at any time, and such changes will become effective upon posting on our website. It is your responsibility to review these terms periodically.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Indian (THE INFORMATION TECHNOLOGY ACT, 2000) Jurisdiction. Any disputes will be subject to the exclusive jurisdiction of the courts in Hubballi Jurisdiction.

By using our shared hosting services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with these terms, please do not use our services.
